The Civil War ended in 1864 and many displaced families moved West into Indian Territory. Danny Duncan is the eighteen-year-old son of a family of frontiersmen who settled in the Choctow Nation of Indian Territory before it was assigned to the Choctow. Until the land was settled, the Duncan family lived by the law of the gun, but they were honest, peaceful people who raised animals and farmed the land. When the land was assigned to the Choctaw, the Duncan family had to buy the land they had farmed for two generations, but they had no money, so they borrowed money from the bank. They made all but the final payment, and it was coming due. The banker wanted the arm, not the payment, so he hired a crooked sheriff to foreclose.
